The damages in a wrongful death case can include an award for the estate itself as well as an award for certain surviving family members. The award to the estate would typically include: lost wages, medical and funeral expenses, and lost accumulation (which is roughly the same as saying the person’s net income had they lived a normal life expectancy). The award to the family members typically include: loss of spousal companionship, loss of parental companionship, loss of protection, loss of guidance and instruction, and emotional pain and suffering.
Even though these may seem like hard things to put a number on, wrongful death verdicts are typically very large.
If you are injured, in most cases, you can recover for:
- medical bills
- pharmacy bills
- lost wages
- physical pain and suffering
- emotional pain and suffering
- disability
- loss of enjoyment of life
In auto wreck cases, you can also recover for:
- rental car cost
- cost to repair or replace your car
- any decrease in the value of your car after the repairs are made
If you are injured in any type of accident, whether it is an automobile wreck, a slip and fall, or any other kind of accident:
Do NOT talk to an insurance adjuster,
DO take pictures of the accident scene and of your injuries,
DO seek appropriate medical attention,
DO contact James P. Kelley, Esq.
